Established in 2006, we have been in the business of providing hire and sales to our customer’s in the Northern Beaches of Sydney and through out Australia. By using or accessing this website in any way, you have agreed to be bound by these terms and conditions.
PADDLECRAFT’s Hire, Tours, Training & Event services are licensed under our NSW Maritime Hire & Drive License #HD0356. All customers are required to obey NSW Maritime Safety Guidelines & Laws in governance of their craft and personal safety, as well as, read and sign Paddlecraft’s Hire Agreement / Indemnity Form prior to commencing their activities and abide by all terms nominated within. Children under the age of 17 years must be accompanied by an adult. PADDLECRAFT also reserves the right to cancel bookings and restrict or deny hire services based on weather conditions. All paddlers are required to wear a certified and approved PFD when paddling. Customers who fail to return equipment or return broken equipment are required to pay replacement value of the equipment.
PADDLECRAFT requires the safe return of the hired equipment in the same condition when hired (fair wear & tear excepted). In the event of the hired equipment is returned in a state other than when hired or the equipment is lost or stolen during the period of hire, the hirer shall be furthur responsible for all additional costs of the damage or the cost of replacement. Return of the equipment beyond the period of hire will also incur a further hire fee at the current hourly full day or weekly rate.
The Hirer will, if not paid in advance, pay PADDLECRAFT for the hire of the paddle craft and all equipment upon return. The Hirer acknowledges that the paddle craft and all accessories are at the hirer’s risk for the duration of the hire period. The Hirer warrants that he / she shall not leave the waters as marked on the map displayed at the store. The Hirer furthur warrants that she / he will obey all rules applicable to paddle craft and such equipment hired by the hirer in relation to the hirer’s conduct of such kayak and equipment as provided by any authority whatsoever. In this regard, the Hirer shall not moor the paddle craft or equipment to any moorings buoys, wharfs, jetties, pontoons or any structure whatsoever. The Hirer is specifically precluded from dragging or moving the paddle craft or any equipment over rocks or oysters.
The Hirer specifically acknowledges that Paddlecraft will not be responsible for any personal injury occasioned to the hirer and any party that may occur in any manner whatsoever for the duration of the hire period. The hirer fully indemnifies Paddlecraft, its officers and employees from any liability whatsoever as a result of damage to person or property occasioned during the hire period and acknowledges that hire of the paddle craft and equipment is at the risk of the hirer.
PADDLECRAFT WARNS ALL HIRERS THAT PADDLING IS A DANGEROUS ACTIVITY, AND THAT THERE ARE INHERENT RISKS INVOLVED IN PADDLING. THE SIGNING OF THIS ‘WARNING OR RISK’ DOCUMENT IS AN ACKNOWLEDGEMENT THAT THE HIRER(S) IS AWARE OF THE INHERENT DANGER INVOLVED IN PADDLING ACTIVITIES. THIS DOCUMENT ALSO ADVISES THE HIRER(S) THAT PADDLECRAFT KAYAKS HAS INSURANCE COVER IN THE EVENT THAT PERSONAL INJURY OR LOSS OF LIFE IS SUSTAINED. IN THE EVENT THAT NEGLIGENCE ON THE PART OF THE HIRER(S) RESULTS IN PERSONAL INJURY OR LOSS OF LIFE THE HIRER(S) IS NOT COVERED BY PADDLECRAFT’S INSURANCE.
All parties acknowledge understanding of the written terms and conditions above as well as the verbal conditions stated during the hire overview and agree that they contain the whole agreement of the parties and that no representations on warranties are made other than those contained herein.
